Please read these Terms of Use carefully before using Longhold. By accessing or using this website and its tools, you agree to be bound by these terms. If you do not agree, please do not use this service.
1. About This Service
Longhold is an online information service operated by Longhold ("Longhold", "we", "us", "our").
The service provides:
- Indicative leasehold premium estimates for lease extensions and collective enfranchisement
- Eligibility checking tools based on information you provide
- Draft statutory notice templates for Section 42 (individual lease extension) and Section 13 (collective enfranchisement) claims under the Leasehold Reform, Housing and Urban Development Act 1993
- General information about leasehold law and reform in England and Wales
2. Information, Not Advice
Longhold provides information only. It does not provide professional valuation advice, legal advice, or any other regulated professional service. Nothing produced by this service constitutes advice of any kind and should not be relied upon as such.
In particular:
- Premium estimates are indicative figures for general information purposes only — they are not formal valuations and do not constitute a valuation report under RICS or any other professional guidance
- Draft notices are templates only — they must be reviewed by a specialist leasehold solicitor before being served on any party
- Eligibility assessments are based solely on information you provide and may not reflect your full legal position
- Nothing on this website should be relied upon when making any financial, legal, or property decision
Before serving any statutory notice, you must instruct a qualified RICS surveyor and a specialist leasehold solicitor. Longhold is designed to help you understand your position before you engage professionals — it does not replace the need for professional advice.
3. Accuracy of Estimates
Premium estimates are calculated using established RICS leasehold valuation methodology, current deferment and capitalisation rates per RICS guidance and Upper Tribunal precedent, and relativity approximations based on standard leasehold valuation practice.
Estimates are only as accurate as the information you provide. If any input is incorrect — including lease length, property value, ground rent, or number of flats — the estimate will be correspondingly inaccurate. Longhold accepts no responsibility for errors caused by incorrect data input.
Actual premiums agreed between parties or determined by the First-tier Tribunal (Property Chamber) may differ materially from Longhold estimates. Longhold accepts no responsibility for any discrepancy between its estimates and any actual premium agreed, determined, or paid.
4. Statutory Notices
Draft notices produced by Longhold are templates populated with information you provide. They are provided for drafting assistance only.
Critical warnings
- All notices must be reviewed by a specialist leasehold solicitor before being served. If you withdraw a valid notice, or it is treated as withdrawn (for example, if you miss a deadline or do not complete), you cannot serve a new Section 42 notice on that flat for 12 months. A notice that is invalid from the start does not trigger this, but it will not protect your claim either, so check it carefully.
- The accuracy of names, addresses, dates, lease particulars, and proposed terms is your sole responsibility — errors can invalidate a notice
- The proposed premium must be a genuine figure based on proper valuation advice. An unrealistically low offer may be challenged and could result in the notice being treated as not genuine
- Section 13 notices must be registered against the freehold title at HM Land Registry immediately after service
- Statutory deposits required on service of a Section 13 notice must be paid within 14 days of the notice date
Longhold accepts no liability for the validity, effectiveness, or consequences of any notice generated using this service.
5. Legislative Position
The Leasehold and Freehold Reform Act 2024 received Royal Assent on 24 May 2024. The majority of its provisions — including the abolition of marriage value and extension of lease terms to 990 years — are not yet in force and await commencement regulations.
Where Longhold presents estimates under the "2024 Act" scenario, these reflect the anticipated position once relevant provisions are commenced. They do not represent the current operative law.
Under current operative law (the Leasehold Reform, Housing and Urban Development Act 1993 as amended):
- Lease extensions are for 90 years added to the unexpired term
- Ground rent on the extended lease is reduced to a peppercorn
- Marriage value applies for leases with fewer than 80 years remaining
- The 2-year ownership requirement has been removed
It is your responsibility to verify the current legislative position with a specialist solicitor before taking any action.
6. Payment and Refunds
Certain products are available on payment of a fee, stated clearly at the point of purchase. All payments are processed securely by our payment provider. Longhold does not store your payment card details.
Refund policy
Because our products are digital documents generated immediately on payment, we are unable to offer refunds once a document has been generated and made available for download. This does not affect your statutory rights.
If you experience a technical failure preventing access to a document you have paid for, please contact us at hello@longhold990.co.uk and we will resolve the matter promptly.
